Agently AI (a product of Affluent Marketing) takes data protection seriously. This Privacy Policy explains how we collect, use, store, share and protect personal data. We aim to comply with India's Digital Personal Data Protection Act, 2023 (DPDP Act), and with the UAE Personal Data Protection Law (PDPL) and other laws where they apply.
1. Introduction
We provide an AI sales workforce for premium clinics. We process personal data about two main groups:
- Clinic Clients: businesses that use our Services, and people who apply on their behalf;
- Patients of Clinic Clients: people who interact with AI agents deployed for our clients.
For Clinic Client data, we decide how the data is used (we are the "Data Fiduciary" or "Controller"). For patient data processed on behalf of a clinic, the clinic decides how it is used and we process it on the clinic's instructions (we are the "Data Processor").
2. Data We Collect
2.1 When you apply or contact us
- Your name, role, email, phone number, clinic name, city and country;
- Information about your clinic you choose to share, such as treatment types, lead volumes, ad spend ranges and the problems you want to solve;
- Booking details if you schedule a call with us.
2.2 From Clinic Clients
- Business name, address, contact details and the names of your team members who use the Services;
- Billing information (card payments are handled by our payment processor; we do not store full card numbers);
- Messages and calls you exchange with us, and how you use the dashboard.
2.3 From patients, on behalf of Clinic Clients
- Phone number and call details (time, duration, source);
- Call recordings, transcripts and AI-generated summaries;
- Name, treatment interest, booking status and other information shared during the conversation;
- Interaction history the clinic shares with us through its CRM or uploads.
2.4 Automatically collected
- IP address, browser, device and operating system;
- Pages visited on agentlyai.in and how you arrived;
- Cookies and similar technologies (see Section 12).
3. How We Use Data
- To review applications and prepare for your strategy call;
- To deliver the Services: running AI agents, handling calls, booking appointments, sending notifications and updating dashboards;
- To tailor agents to each clinic: training them on that clinic's treatments, scripts and pricing, kept separate for each clinic;
- For reporting: tracking performance and recovered revenue against agreed targets;
- To communicate with you: service updates, billing notices and policy changes;
- For legal compliance and to enforce our Terms;
- To improve the Services using aggregated, anonymised data that cannot identify you or any patient.
4. Legal Basis for Processing
- Consent: for example, when you submit an application or when patients consent to call recording;
- Contract: to perform our service contract with Clinic Clients;
- Legitimate uses permitted by law: such as security and fraud prevention;
- Legal obligation: where the law requires us to process data.
5. Patient Data: Extra Protections
- Clinic responsibility: clinics are responsible for obtaining the patient consents the law requires for calls, recordings and data processing;
- No marketing by us: we never use patient data for our own marketing or to contact patients for other clinics;
- Separation between clients: each clinic's data is kept logically separate, and one clinic's patient data is never used to train agents for another clinic;
- Health information: where conversations touch on health, we treat that data with extra care and limit access to it.
For Clinic Clients: You must tell your patients that calls may be recorded and handled by an AI agent, and obtain consent where the law requires it. We provide standard disclosure wording that our agents can use at the start of calls.
6. AI Agents
The agents that call or answer patients on behalf of our clients are AI. They are designed to say they are AI if a caller asks. Calls are recorded and transcribed so that clinics can review conversations and so we can improve that clinic's agents. Decisions about treatment are always made by the clinic and the patient, never by our agents.
7. Sharing Data
We do not sell personal data. We share it only with:
- Service providers that help us deliver the Services, such as voice and telephony, AI model, cloud hosting, messaging, calendar and payment providers. They may only use the data to provide their service to us;
- The relevant Clinic Client, for patient data collected on its behalf;
- Authorities, where required by law or to protect rights and safety;
- A successor business, in the event of a merger or acquisition, with notice to you.
8. International Transfers
We are based in India. Some of our service providers process data in other countries, such as the United States. Where data leaves its country of origin, we rely on contractual safeguards with those providers and follow the cross-border transfer rules of the DPDP Act, PDPL and other applicable laws.
9. Data Retention
| Data | How long we keep it |
| Application and enquiry data | Up to 24 months if you don't become a client |
| Call recordings & transcripts | 12 months from the call, or as set in your contract |
| Patient lead records | Contract duration + 90 days |
| Clinic Client account data | Contract duration + as required for tax and legal purposes |
| Billing records | As long as tax law requires |
| Aggregated anonymised data | Indefinitely (cannot identify anyone) |
When a Clinic Client's contract ends, we export its patient data to the clinic and delete it from our systems within 90 days, unless the law requires us to keep it.
10. Your Rights
Depending on where you live, you may have the right to access, correct or erase your personal data, withdraw consent, nominate someone to act for you, object to certain processing, and complain to a data protection authority.
To make a request, email hello@agentlyai.in with the subject "Privacy Request." We will respond within 30 days.
Patients: please send requests to the clinic you dealt with, as it controls your data. We will help the clinic respond.
11. Security
We use reasonable technical and organisational measures to protect personal data, including encryption in transit and at rest, access limited to people who need it, and multi-factor authentication on our key systems. No system is perfectly secure, but if a breach affects your data, we will notify you and the relevant authorities as the law requires.
12. Cookies
agentlyai.in uses essential cookies to work, and may use analytics cookies to understand how visitors use the site and, with consent where required, marketing cookies to measure ads. You can control cookies in your browser settings.
13. Children
Our Services are for businesses and adults. We do not knowingly collect data from children through this website. If you believe a child's data has been shared with us, contact us and we will act on it.
14. Jurisdiction Notices
